Sir Anerood Jugnauth : « Ni contrôle ni responsabilité sur les missions à l’étranger de la Speaker »

« Les fonctions de Speaker sont indépendantes de l’exécutif. De facto, je n’ai ni contrôle ni aucune responsabilité sur les missions à l’étranger de la Speaker. C’est à elle d’accepter ou de refuser une invitation », a soutenu le Premier ministre sir Anerood Jugnauth en réponse à la question d’Aadil Ameer Meea. Sir Anerood Jugnauth a aussi fait comprendre qu’il y a une séparation de pouvoirs entre l’exécutif et le législatif : « L’exécutif n’a rien à faire et ne peut intervenir dans la décision de la Speaker dans l’exercice de ses fonctions. » Le Premier ministre a pris l’exemple de la House of Commons du Royaume-Uni et de la Lok Sabha, chambre basse du Parlement indien. Dans le premier cas, il a souligné que des questions portant sur la compétence du Speaker doivent être prises en privé avec lui-même, et à la Lok Sabha des questions sur le Speaker ne sont pas autorisées. « Madam Speaker, « The Honourable Member should know that there is a separation of powers between the Executive and the Legislature. This question raises an issue which falls squarely under the control of the Legislature, which, in our constitutional set up, is independent from the Executive. Moreover, the Legislature and the Executive are subjects of different chapters of our Constitution. « Having said so, it is a well-known constitutional principle that the office of the Speaker is independent. I have neither control nor responsibility on overseas missions, and the decision to accept or refuse an invitation to attend a conference rests solely with the Speaker acting in her wisdom, and taking into consideration different factors. « The Executive has nothing to do and cannot interfere in the decision of the Speaker in the exercise of her duties. Therefore, my interference in matters under the control of the Speaker would be against the principle of separation of powers as enshrined in our Constitution. To this end, it is worth referring to what obtains in the UK House of Commons and the Lok Sabha. In the House of Commons, questions dealing with matters under the jurisdiction of the Speaker must be taken in private with the Speaker. In the Lok Sabha, questions on matters which come under the administrative control of the Speaker are disallowed. « In the present case, the House may wish to know that the Speaker has used her discretion, despite the provision of our Standing Orders, to allow the Question », a déclaré le Premier ministre sir Anerood Jugnauth en réponse à la question d'Aadil Ameer Meea.
