Kailash Trilochun case: New twist and turn

New twist and turn in the case of Kailash Trilochun. Sylvio Jose Candahoo, suspected of being the aggressor of the Chairman of ICTA Bhanooduth Beeharee, has made serious allegations against Kailash Trilochun.

He said he had acted on the instruction of the latter. The assault of the Chairman of ICTA, as per the statement of Sylvio Jose Candahoo is allegedly related to the late payment of fees. The police now want to verify the allegations of Sylvio Jose Candahoo and question Kailash Trilochun. The lawyer is not currently in Mauritius. Sources from Line Barracks indicate that Kailash Trilochun can be arrested upon arrival. 

It is to be recalled that Kailash Trilochun is in the news since two weeks now after his name was mentioned in the National Assembly regarding a legal case he took on behalf of ICTA against Emtel where he received fees amounting to Rs 19 million. 

The lawyer said that he does not intend to apologise for the money he received because it was paid under the terms of the ICTA. In a communiqué, he stated: “I have appeared before the Privy Council on several occasions and some of my cases are now landmark cases that have influenced the course of justice in Mauritius and many other jurisdictions. All my actions, initiatives and strategies are framed by parameters enshrined in the Code of Ethics of Barristers which lay emphasis on transparency, fairness and reasonableness of fees taking into consideration the complexities of a case.”

A third suspect arrested 

After Sylvio Candahoo, José and his brother Pascal Collet, a third suspect was arrested on Wednesday by the CCID as part of the investigation of the assault of Bhanoodutt Beeharree occurred in Port-Louis in May 2016. The third suspect, a man named Christophe Benoit, is suspected to be involved in the attack and it was Sylvio Candahoo who gave his name. 

Search for a fourth suspect

As the investigation is on, police officers are unfolding new elements in the assault case of the Chairman of ICTA. Known to the police, the fourth man could shed light on other elements on the involvement of Kailash Trilochun in this case. According to ACP Devanand Reekoye, the fourth man could have acted as middle man. 

Rama Valayden promises a ‘surprise’ 

Rama Valayden, who is the lawyer of Kailash Trilochun, has stated that his client is a victim of a big conspiracy and is not involved in the assault. Rama Valayden says he has known Kailash Trilochun since long. “We may not share the same political side, but I really do not see him doing such a thing,” he said. For him, his client is facing a case of false accusation. He has promised a ‘surprise’ soon. 

Me Ashley Hurhangee questions the CP

Barrister Me Ashley Hurhangee has shared to the press a list of seven questions he said he has put to the Commissioner of Police, Mario Nobin, relating to the Trilochun case. Me Hurhangee says he has, “as with many other Mauritian citizens, learnt of the very serious allegations made against Maitre Kailash Trilochun in the brutal attack against the Chairman of the ICTA. These are allegations and everyone is presumed innocent until proof to the contrary in a court of law and Maitre Trilochun must be afforded every opportunity to defend himself. However, I do have some very serious concerns and I shall be grateful if you would kindly provide me with the following answers which I am sure most Mauritians would also like to know.” The seven  questions addressed to the Commissioner of Police are as follows:

  1. You retained the services of Maitre Trilochun to represent you and I believe he is still your counsel. Is it therefore not against ethics and is there not a conflict and an appearance of bias for the enquiry to be under your supervision as head of the police force?
  2. Should you not have disclosed to the Minister of Interior the conflict from the very moment you were made aware of the allegations several days back?
  3. Have you had any contact with Maitre Trilochun since the arrest of the suspect Candahoo?
  4. How many times have you been briefed by the enquiry team on development of the enquiry?
  5. Should you not take leave until the enquiry is over as in the case of DCP Seerungen? 
  6. What measures have you taken to ensure the enquiry is handled without any interference?
  7. When was Maitre Trilochun issued with a new passport?

At the time of going to press, Me Ashley Hurhangee confirmed to News on Sunday that he has not received any reply to his questions. Me Hurhangee stated that it is in the public interest that the Commissioner of Police answers the questions asked.
