Affaire Roches-Noires : le DPP ne fera pas appel

L'ancien Premier ministre, Navin Ramgoolam, à sa sortie de la Cour lors d'une de ses comparutions

Le bureau du Directeur des Poursuites Publiques (DPP) ne fera pas appel de la décision de la Cour intermédiaire, qui avait rayé les accusations pesant sur l'ex-Premier ministre, Navin Ramgoolam, et deux anciens hauts-gradés de la police, Rampersad Sooroojbally et Dev Jokhoo, dans l'affaire Roches-Noires, le vendredi 13 septembre.

«The ODPP (Office of the Director of Prosecutions) has come to the conclusion that there is no reasonable prospect of a successful appeal in this matter», affirme le bureau du DPP dans un communiqué émis ce vendredi après-midi 27 septembre.

    The Office of the Director of Public Prosecutions (ODPP) has given due consideration to a Ruling (on a Submission of No Case to Answer made by the Defence) dated 13 September 2019, wherein the Court has found that “at the close of its case, taken at its highest, the prosecution has not established a prima facie case against the accused parties” and dismissed the case against all 3 accused parties.

After consideration of the Ruling and the reasons given by the Court to dismiss the case against all 3 accused parties, the ODPP has come to the conclusion that there is no reasonable prospect of a successful appeal in this matter.

    The case against all 3 accused parties had always been premised on the fact that the enquiry had disclosed no conclusive evidence that a larceny had in fact occurred at the material time in the bungalow of Dr NavinchandraRamgoolam.However, the evidence that transpired during the latter stage of the trial (mainly from one of the enquiring officers in the case), and as highlighted by the Court in their Ruling, went contrary to that premise. 

    In the light of the above, the ODPP has today advised the Commissioner of Police that there should be no further action in this matter.
