Aux Archives nationales : le Public Bodies Appeal Tribunal désavoue l’ancien Director of Culture en annulant une nomination

L’ancien Director of Culture, Gowoothum Soobarah, a été vertement critiqué par le Public Bodies Appeal Tribunal (PBAT) pour son rôle dans une nomination, qui selon l’instance « dépasse toute logique ». Cette nomination a, par conséquent, été « quashed ».

Le PBAT, présidé par Shirin Aumeeruddy-Cziffra, a pour tâche de passer en revue toute contestation de nomination au sein de la Fonction publique. Le 29 juin dernier, le tribunal a rendu son verdict concernant une nomination au poste d’archiviste aux Archives Nationales. L’affaire avait été portée devant l’instance par Dewanand Bagha pour contester la nomination de Dharmendra Mukool au poste d’archiviste. Dans le jugement du PBAT, c’est l’apport de Gowoothum Soobarah, qui agit comme conseiller auprès de la Public Service Commission (PSC) pour le choix du meilleur candidat, qui est l’élément qui a fait pencher la balance en faveur du contestataire.

« The more disturbing element is the marks given by the Adviser on the selection panel. In spite of the fact that the Appellant had more marks on the key criteria, the Adviser gave very high marks to the Co-Respondent and very low marks to the Appellant which wiped out the advantage the Appellant had on the Co-Respondent », peut-on lire dans le document.

Pour faire simple, Le tribunal est d’avis que le Director of Culture d’alors a inversé complètement les points qu’auraient dû obtenir les deux candidats et ainsi vicié la procédure. Les termes choisis sont durs : « The Tribunal finds that the assessment of the Adviser is flawed and defies logic. » Plus loin, le PBAT approuve Dewanand Bagha, qui estime que l’ancien Director of Culture n’avait pas sa place au sein du panel de sélection. « The Tribunal agrees that the Adviser was not the appropriate person on the panel as he was not versed on archival matters to enlighten the panel on the technical functions of the post. In allowing the wrong person on the panel, the outcome of the selection exercise has been vitiated as Appellant scored better on most of the criteria », a fait ressortir le PBAT.

Et la conclusion : « In the light of the above findings, the Tribunal strongly believes that the selection exercise has been vitiated by the wrong assessment of the Adviser on the selection panel. The decision of the Respondent is therefore quashed. »

Nous avons contacté Gowoothum Soobarah pour une réaction concernant ce jugement. Celui-ci il a indiqué qu’il ne pouvait faire de commentaires à ce sujet : « En tant qu’Adviser auprès de la PSC, je suis lié par la Secrecy Act. Je ne peux commenter ce jugement. »

La PSC a 21 jours pour contester le jugement en Cour suprême.
