Affaire MedPoint : l'Icac réagit et affirme que toute décision a été prise dans le strict respect de la loi

L'Independent Commission Against Corruption (Icac) réagit à un article publié dans le quotidien l'express ce mardi matin portant le titre «Medpoint: l’indécente volte-face de L’ICAC». 

Dans un communiqué émis ce mardi après-midi, la commission anticorruption dit exprimer des «réserves» sur le contenu de l'article en question qui, selon elle, serait «based on incomplete information, inaccuracies and wrong interpretations».

Selon l'article, l’Icac a changé son fusil d’épaule à quelques semaines du procès en appel dans l’affaire MedPoint au Privy Council. Le quotidien rapporte que la commisssion anticorruption, qui avait initié un procès contre Pravind Jugnauth sous une accusation de conflit d’intérêts et en vertu de l’article 13(2) de la Prevention of Corruption Act (PoCa), va désormais se ranger sur l’argumentaire des hommes de loi du Premier ministre en affirmant dans une correspondance au Privy Council que la commission anticorruption a décidé de revoir sa position. Désormais, l’Icac présentera des plaidoiries lors du procès en appel. 

Cependant, l'Icac soutient dans son communiqué que «any decision in relation to the present appeal pending before the Judicial Committee of the Privy Council has been taken in strict compliance with the rule of law, procedure and in respect of the judicial process». Et d'ajouter que toute décision prise dans cette affaire a été faite «in line with independent legal advice obtained by the Commission. Such decisions are in conformity with current practice in any court of Law».

C'est ce mardi 15 janvier 2019 que l’appel interjeté par le Directeur des poursuites publiques (DPP), Me Satyajit Boolell, pour contester le verdict acquittant le Premier ministre, Pravind Jugnauth, dans l’affaire MedPoint, sera entendu devant le Privy Council.

Le 22 juin 2017, le DPP avait obtenu une autorisation de la Cour suprême de recourir au Privy Council pour faire appel du jugement d’acquittement prononcé en faveur de Pravind Jugnauth. Le 2 juillet 2015, le leader du MSM avait écopé de 12 mois de prison. Un verdict contesté par le Premier ministre.

Ci-dessous le communiqué de l'Icac :

The Independent Commission Against Corruption has taken cognisance of the press article which appeared in L’Express of today, 8th January 2019, under the heading “Medpoint: l’indécente volte-face de L’ICAC”. The Commission expresses reservations as to the contents of the said article which are based on incomplete information, inaccuracies and wrong interpretations.

However, the Commission wishes to state that any decision in relation to the present appeal pending before the Judicial Committee of the Privy Council has been taken in strict compliance with the rule of law, procedure and in respect of the judicial process. In so doing, the Commission acted in good faith, and without fear or favour.

The Commission also wishes to point out that any decision taken in relation to the present appeal between the 6th February 2018 and 22nd November 2018, regarding, inter alia

1. appearance before the Privy Council;

2. offer of submissions;

3. representation by counsel

has been in line with independent legal advice obtained by the Commission. Such decisions are in conformity with current practice in any court of Law.

In the circumstances, the Commission calls for restraint in view of the subjudice nature of the present appeal which is to be determined next week, as any comment on the matter may be construed as contempt of court.
